SOCIAL SECURITY WEP & GPO LEGISLATIVE UPDATE
Posted On: Oct 09, 2018

The Social Security Fairness Act (H.R. 1205/S. 915) would fully repeal the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO)).  The House bill currently has 190 cosponsors, only 28 short of a House majority and the Senate bill has 26 cosponsors.  This is more support than we have had in the last few Congress.  These two bills are a top legislative priority for the FOP.

Earlier last month, Senator Toomey introduced S. 3433, legislation which would repeal the WEP and GPO for law enforcement officers and firefighters.  It currently has no cosponsors.

On October 5th, Representative Kevin P. Brady (R-TX) introduced H.R. 6933, the “Equal Treatment of Public Servants Act,” which is based, in part on H.R. 711 from the previous Congress.  We are still analyzing the bill.

Last Wednesday, the House Committee on Rules met to debate and pass a rules package for the consideration of several bills, including H.R. 6757, the “Family Savings Act.”

A few hours before the hearing the FOP was advised that H.R. 1205, the “Social Security Fairness Act,” was going to be offered as an amendment to H.R. 6757 in committee. Representative Graves (R-LA) offered the amendment and Representative Davis (R-IL), the sponsor of H.R. 1205, appeared before the committee as a witness and spoke strongly in favor of the legislation. No Member of the Committee spoke against the amendment and, in fact, 6 Members of the Committee are cosponsors of H.R. 1205

The Rules Committee held one vote to consider the “Social Security Fairness Act” and two other amendments as one package. For procedural reasons, House and Committee leadership favored a “closed rule” meaning that no amendments would be considered in order and that the bills, including H.R. 6757, would have an up and down vote on the floor without considering any amendments to the bill. The amendments package was defeated on a party line 3-7 vote and as reported above, the underlying bill was pressed without amendment.
